Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the personal portfolio website at www.iampapaisarkar.dev and the companion mobile application published as iampapaisarkar (together, the “Services”), operated by Papai Sarkar (“I”, “me”, or “the Operator”), based in Siliguri, India.

By accessing the website, installing the mobile app, or signing in with Google, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Services.

1. Who these Terms apply to

The Services are a personal brand and portfolio experience: they showcase selected software projects, case studies, skills, and related materials. They are intended for recruiters, hiring managers, clients, collaborators, and other visitors who want to learn about my work.

You must be at least 13 years old (or the minimum digital-consent age in your country) to create an account. If you use the Services on behalf of an organization, you confirm you have authority to accept these Terms for that organization.

2. The Services

Depending on the surface you use, the Services may allow you to:

• Browse public portfolio projects, descriptions, screenshots, and related media
• Sign in with Google to sync a lightweight profile on the mobile app
• Save favorite projects and view downloadable build links where made available
• Contact me through the website contact form

Features may change, expand, or be discontinued at any time. Portfolio content is curated and may be updated without notice.

3. Accounts and authentication

Mobile app accounts are created through Google Sign-In and Firebase Authentication. You are responsible for maintaining control of your Google account and for activity that occurs while signed in on your devices.

I may suspend or terminate access if I reasonably believe you are misusing the Services, attempting unauthorized access, abusing downloads, or violating these Terms or applicable law.

4. Acceptable use

You agree not to:

• Scrape, harvest, or bulk-download content or media beyond normal personal browsing
• Attempt to probe, scan, or breach the API, authentication, or storage systems
• Interfere with rate limits, security controls, or other users’ access
• Republish my portfolio materials as your own commercial product without permission
• Use the Services to send spam, malware, or unlawful content via any contact channel
• Misrepresent your identity when contacting me or interacting with authenticated features

5. Intellectual property

Unless otherwise stated, the website design, branding (including “Papai.”), written case-study copy, screenshots, icons, and other original materials are owned by Papai Sarkar or used under license. Viewing portfolio work does not transfer ownership of source code, designs, trademarks, or client deliverables.

Some showcased products may belong to clients or employers. Those works remain the property of their respective owners. Public display on this portfolio does not grant you a license to copy, redistribute, or commercialize those products.

You may share links to public pages for legitimate professional purposes (for example, recruiting or networking). You may not mirror the site, reverse-engineer protected builds, or remove attribution from materials I provide.

6. Downloads and third-party software

Where APKs or other binaries are offered, they are provided for evaluation or demonstration unless a separate license says otherwise. Downloads may require authentication and may be logged for security and abuse prevention.

Install builds only from sources I provide through the Services. You are responsible for verifying that installing third-party packages is permitted on your device and complies with your employer’s policies. I am not responsible for device damage, data loss, or policy violations arising from sideloading or installing demo builds.

7. Third-party services

The Services rely on third parties such as Google (Sign-In), Firebase (Authentication), hosting and cloud storage providers, and email delivery for contact messages. Your use of those providers is also subject to their own terms and privacy policies.

8. No professional advice; no employment or client guarantee

Portfolio content is informational. It is not legal, financial, or career advice, and it does not create an employment, agency, or client relationship. Project outcomes described in case studies reflect past work and do not guarantee future results.

9. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, I disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by applicable law, Papai Sarkar will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities arising from your use of the Services. Aggregate liability for claims relating to the Services shall not exceed INR 5,000 or the amount you paid me (if any) for the specific Service giving rise to the claim in the twelve months before the claim, whichever is greater.

Some jurisdictions do not allow certain limitations; in those places, liability is limited to the maximum extent permitted by law.

11. Indemnity

You agree to indemnify and hold harmless Papai Sarkar from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your infringement of another party’s rights.

12. Changes

I may update these Terms from time to time. The “Effective date” above will change when material updates are published. Continued use after changes become effective constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of India. Courts in Siliguri / West Bengal shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply in your place of residence.
